Kampala High Court Civil Divison Judge, Hon. Justice Acellam Collins has set Monday September 1, 2025 as the hearing date of the application filed by the relatives and friends of the missing Sam Mugumya seeking for his production before court, alive or dead.
Through their legal team of Kiiza and Mugisha Advocates, they want court, to issue an order for a writ of habeas corpus ad subjiciendum (order that commands a person detaining another individual to produce that individual before the court to determine the legality of the detention) against the CDF, Directorate of Intelligent and the Attorney General.
In an affidavit sworn by Tumusiime Kakuru, Mugumya was arrested on Monday, 26th August 2025 from Mbarara and is currently detained at Mbuya military detention facility manned by Directorate of Intelligence and Security.

They accuse Sc Kiryowa Kiwanuka as the AG, Gen. Muhoozi Kainerugaba, Chief of Defense Forces, (CDF), and Major General Richard Otto Director of Intelligence and Security (DIS), for illegally hold Mugumya.
“An order for a writ of habeas corpus ad subjiciendum issues to: The CDF, Directorate of Intelligence & AG.” One of the prayers reads.
“That the body of Sam Mugumya be produced in court.” Reads the second prayer.
It should be recalled, that this isn’t the first time for Sam Mugumya to be arrested, because he arrested once arrested on October 21, 2014 before being arraigned in DR. Congo courts and subsequently jailed for over 8 years in Ndorwa Military Prison of the same country.
Upon completion of the sentence, Mugumya ran to exile, before he decided to run home, and by the time of his kidnap, he was aspiring to contest as the People’s Front for Freedom’s flag bearer for Rukungiri Municipality, the position that Gen. Henry Tumukunde too, is aspiring for, on NRM ticket.
